TERMS AND CONDITIONS

1. GENERAL CONDITIONS

(i) You must be 18 years of age or older to register, use the Services, or visit or use the Application in any manner. By registering, visiting and using the Application, you represent and warrant that you are 18 years of age or older, and that you have the right, authority and capacity to use the Application and the Services available through the Application, and agree to and abide by the terms mentioned herein.

(ii) You acknowledge that you will be bound by the terms and conditions mentioned herein for availing any of the Services offered by Dr. Reddy’s. If you do not agree with any part of the terms and conditions, please do not use the Application or avail any Services.

(iii) The use of any images displayed in the Application must be read in the specific context and should not be construed beyond the specific purpose for which it is displayed. Display of images is for illustrative purposes and may not be an exact representation of the product. Use of certain images is only to prevent confusion on non-prescription products that are described by this Application and to distinguish the product attributes, so as to discourage self-medication or use of such products by persons who are unfamiliar with these.

(iv) The offerings on the Application may change from time to time, at the sole discretion of Dr. Reddy’s , and this terms and conditions will apply to all visits, and use of the Application to avail/provide the Service, as well as to all information accessed from the Application at any given point in time.

(v) The Application or its content thereof does not endorse or promote self-medication. Self-medication can be hazardous and harmful hence all products under drug license should be consumed or used only under supervision of a registered medical practitioner.

(vi) Dr. Reddy’s reserve the right to modify or terminate any portion of the Services, and the terms hereof for any reason and at any time, and such modifications shall be automatically updated. You should read the terms and conditions at regular intervals. Your use of the Application following any such modification constitutes your agreement to follow and be bound by the revised terms

(vii) Your access to use of the Application and the Services will be solely at the discretion of Dr. Reddy’s.

2. TERMS OF USE APPLICABLE TO ALL END USERS

(i) This Application is operated and managed by a third party under the supervision of Dr. Reddy’s. The End User understands and agrees that the primary objective of this Application is to be provide reliable and scientifically verified content on hair care. Dr. Reddy’s including but not limited its Affiliates does not recommend or endorse any specific tests, physicians, products, procedures, opinions, or any specific medical advice.

(ii) The Application aims to provide helpful information pertaining to hair care and to avail other resources through third party platforms linked to this Application. You understand and agree that any services availed at the Application or through third party platforms whose link is provided at the Application, is solely at your discretion and the Application does not require you to avail such services as a pre-requisite to access (or continue to access) its contents. Any services availed at or through a third party platform will be governed by the terms of such third party platform

(iii) The Application may provide the End User with an option to connect with our support partners who may assist you in seeking expert consultation from a qualified dermatologist. Any such contact with a third party support partner and consequent consultation between the End User and a dermatologist will be an independent and direct engagement between them, to which Dr. Reddy’s is not a party. Dr. Reddy’s role is to merely enable easy access of consultation for better health outcomes without any access to or influence over such consultation and without liability or obligation of any nature whatsoever, to either the End User or the Practitioner. If you opt to connect with an expert, your interaction with the dermatologist will be in an individual capacity and Dr. Reddy’s shall not be responsible for the conduct, professional services and interaction that the third party website. application and/or dermatologists independently provide to you. You understand and agree that such facilitation of appointment and consultation does not create a doctor-patient or other commercial or economic relationship, between you and Dr.Reddy’s.

(iv) This Application does not sell or promote any medicine and the use of this Application does not constitute an invitation or encouragement to use or buy any drug/medicines. The information of any products of Dr. Reddy’s Laboratories Limited if made available on this Application is not intended to be, nor should be interpreted as, advice, solicitation or a recommendation concerning the use of the product. You must always consult a registered medical practitioner, before the use of any of our products. You understand and agree that your use of the Application does not constitute an opinion, medical advice, or diagnosis or treatment of any particular condition by Dr. Reddy’s but is only a platform provided to assist you with valuable information relating to hair care.

(v) While Dr.Reddy’s takes reasonable steps to ensure that the credentials of all third party partners of the Application including dermatologists associated with the third party are verified, Dr.Reddy’s make no guarantees, representations or warranties, whether expressed or implied, with respect to professional qualifications, quality of work, expertise or other information provided by the third party platform and/or the dermatologists enrolled on its platform.

(vi) Although Dr.Reddy’s has attempted to provide accurate links and up-to-date information, no guarantee is made to this effect. The use of this Application is voluntary and the use of any information provided on this Application is at your own risk. Dr.Reddy’s disclaims all liability in respect of anything done or not done pursuant to the information supplied on this Application, to the fullest extent permitted by law. Dr. Reddy’s makes no representations on the accuracy or completeness of the information on this Application or obtained by following any link through this Application and will not be liable for any losses, damages, injuries from the display or use of the information furnished herein.

3. TERMS OF USE APPLICABLE TO ALL PRACTITIONERS

(i) You understand and agree that the intent of this Application aims to provide helpful information on hair care and does not host any consultation services or act as an interactive platform for Practitioner and End User. The Application, only acts as a mere facilitator to direct the End User to a third party platform that hosts qualified Practitioners like yourself and enables the End User to avail consultation services from you.

(ii) You have agreed to be listed in this Application out of your own volition and the terms mentioned herein shall be in addition to the terms mentioned in your engagement letter. You agree that your personal details will be made available to the End User who may contact you at their volition and you are solely liable for any engagement consequent to such contact. You agree that your interaction with the End User will be in accordance with applicable laws and your professional code of conduct. Any contravention of applicable law as a result of your negligence or misconduct is your sole responsibility, and Dr. Reddy’s shall not be liable or held accountable in any manner for your professional conduct with the End User.

(iii) This Application does not prescribe any drugs or medicines and is purely in public interest and your enlistment with the Application shall not be construed to a) require you to promote, purchase, prescribe or otherwise recommend any product or services; or b) influence or interfere with your clinical decision making.

4. COPYRIGHT

(i) This Application may contain several material such as publications, medical journals, literature, articles, etc. (“Content”), which are either developed internally by Dr.Reddy’s or sourced from external third parties. Each Content made available on the Application is protected under copyright laws and use of such Content shall be done in accordance with the terms of use for each such Content.

(ii) This Content is being shared by Dr.Reddy’s as a public awareness initiative and for informational purposes to the User. Any expert comments expressed in the Content, are solely the views of the author. Dr.Reddy’s shall not be responsible or in any manner liable for any injury and/or damage to any persons in view of any errors, omissions or inaccuracies and/or incompleteness in this publication, whether arising from negligence or otherwise. This Content or any part thereof shall not be copied, reproduced, stored or reprinted without the prior written permission of Dr.Reddy’s or the copyright holder. Dr. Reddy’s shall not be liable for any plagiarism or infringement by any user and such user shall keep the Company indemnified of any liabilities from your unauthorised and /or wrongful use of the Content.

(iii) The Content on this Website is not intended to be a substitute for professional medical advice, diagnosis or treatment. The Content mentioned herein is generic by nature and the applicability may differ from individual to individual. Hence, End User must seek the advice of a physician or other qualified health provider for any specific information or any medical condition

(iv) In case of non-compliance with any applicable laws, rules or regulations, or the terms mentioned herein (including the Privacy Policy) by a User, Dr.Reddy’s has the right to immediately terminate the access or usage rights of the User to the Website and Services and to remove non-compliant information from the Website.

5. LIMITATION OF LIABILITY

In no event, including but not limited to negligence, shall Dr. Reddy’s, or any of its directors, officers, employees, agents (collectively, the “Entities”) be liable for any direct, indirect, special, incidental, consequential, exemplary or punitive damages arising from, or directly or indirectly related to, the use of, or the inability to use, the Application or the content, materials and functions related thereto, even if such parties has been advised of the possibility of such damages. In no event shall the Entities be liable for any liability arising from or in relation to:

i) provision of or failure to provide all or any Service by Practitioners to End- Users contacted through the Application;

ii) any unauthorized access to or alteration of data or Content for no fault of Dr.Reddy’s

iii) the delay, failure, interruption, or corruption of any data or other information transmitted by or through the Application.

6. APPLICABLE LAW

The terms of this Application will be governed by the laws of India and the courts at Hyderabad shall have exclusive jurisdiction over any disputes arising out of or in relation to the use of this Application or the Services or the information to which it gives access.

By proceeding to use this Application and accessing its contents, you agree that you have read and fully understood the above and that you agree to abide by the foregoing as a condition of your use and access to this Application.
